Separation of Powers: A Perfect Recipe for Good Governance.

Babs Adesanya

The expected synergy between the Legislature, Judiciary, and Executive arms of government in Nigeria is rooted in the principle of separation of powers and checks and balances. This system ensures that power is not concentrated in one arm of the government, but shared and monitored by the other arms. Here is an overview of the expected synergy between these three arms in Nigeria:

Legislature (National Assembly)

The National Assembly consists of two chambers – the Senate and the House of Representatives. Its primary responsibilities are lawmaking, budget enactment, and oversight of the executive branch. The synergy between the Legislature and the other arms can be seen in the following ways:

a. Lawmaking: The Legislature proposes, debates, and passes bills into law. This legislative function is essential for governance and advancing the objectives of the government.

b. Checks and Balances: The Legislature conducts oversight on the Executive branch by investigating its actions, approving budgets, and confirming appointments. This oversight helps ensure accountability.

c. Collaboration: The Legislature collaborates with the Executive branch through consultations, public hearings, and budget negotiations to develop and implement policies in the interest of the nation.

Judiciary

The Judiciary is responsible for interpreting and applying the law. It ensures that justice is administered impartially and provides a check on the power of the other arms of government. The synergy between the Judiciary and the other arms includes:

a. Adjudication: The Judiciary settles disputes and conflicts between citizens and the government or between different branches of government. It ensures that actions of the Executive and Legislature are consistent with the Constitution and laws.

b. Judicial Review: The Judiciary has the power of judicial review, allowing it to assess the constitutionality of laws and executive actions.

c. Independence: The Judiciary should be independent from political interference or influence. This independence guarantees fair judgments and prevents the abuse of power by the other arms of government.

Executive

The Executive branch, led by the President, is responsible for implementing and enforcing laws. Key areas of synergy include:

a. Policy Implementation: The Executive implements laws passed by the Legislature and ensures their effective execution.

b. Cooperation: The Executive collaborates with the Legislature by providing information, attending hearings, and seeking legislative support for its policies and initiatives.

c. Respect for Judiciary: The Executive respects and complies with court decisions and supports the independence of the Judiciary.

Overall, the expected synergy among the Legislature, Judiciary, and Executive arms of government in Nigeria is crucial for a functional democracy. It ensures a balance of power, accountability, and the effective functioning of the government for the development and well-being of the nation.
